Terms of Service

Introduction
These Terms of Service (hereinafter referred to as "these Terms") set forth the conditions for use of the iOS application "TouringTrace" (hereinafter referred to as "the App") provided by Shoichi Taguchi (hereinafter referred to as "the Operator").
By downloading, installing, or using the App, you are deemed to have agreed to these Terms. If you do not agree to these Terms, you may not use the App.
Article 1 (Definitions)
The following terms used in these Terms are defined as follows:
- "User": Any person who uses the App.
- "the Service": All services provided through the App.
- "Content": All data entered, registered, or stored by the User in the App (including motorcycle information, maintenance records, ride records, images, etc.).
Article 2 (Description of the Service)
The App is a motorcycle management application that provides the following features:
- Registration, editing, and management of motorcycle information
- Automatic vehicle information entry by scanning vehicle inspection certificate QR codes
- Maintenance record management
- GPS-based ride recording (route, distance, speed, and time tracking)
- Ride history viewing and statistical analysis
- Motorcycle route display on maps
- Dashboard (recent rides, maintenance alerts, and statistical summaries)
- Real-time ride information display via widgets and Live Activity
- Other features that the Operator may add from time to time
Article 3 (Terms of Use)
- Users shall use the App in accordance with these Terms.
- If a minor wishes to use the App, please obtain the consent of a legal guardian before use.
- Use of the App requires an Apple device running iOS 18.0 or later.
- Use of certain features (ride recording, map display, etc.) requires permission to access location services.
- Use of certain features (QR code scanning) requires permission to access the camera.
Article 4 (Account)
- The App automatically generates a user identifier through Firebase Anonymous Authentication. No account registration with an email address or password is required.
- Users shall use the App at their own responsibility.
Article 5 (User Responsibilities)
- Users shall enter accurate information in the App at their own responsibility.
- Users shall back up the Content entered in the App at their own responsibility.
- If any dispute arises between a User and a third party in connection with the use of the App, the User shall resolve such dispute at their own expense and responsibility.
- While using the ride recording feature, please comply with road traffic laws and other applicable regulations and drive safely. Never operate the App while riding.
Article 6 (Prohibited Activities)
Users shall not engage in any of the following activities when using the App:
- Activities that violate laws, regulations, or public order and morals
- Activities related to criminal acts
- Activities that interfere with the functionality of the App's servers or network
- Reverse engineering, decompiling, or disassembling the App
- Extracting or copying the source code of the App
- Activities that may interfere with the operation of the App
- Unauthorized access or attempts thereof
- Impersonating other Users
- Using the App for fraudulent purposes (such as registering false vehicle inspection certificate information)
- Activities that infringe upon the intellectual property rights, privacy rights, reputation, or other rights or interests of the Operator, other Users, or third parties
- Other activities deemed inappropriate by the Operator
Article 7 (Intellectual Property Rights)
- All intellectual property rights (including copyrights, trademark rights, patent rights, etc.) related to the App and the Service belong to the Operator or third parties who hold legitimate rights.
- Users are granted a non-exclusive and non-transferable license to use the App under these Terms, but do not acquire any intellectual property rights related to the App.
- Rights to the Content entered by Users in the App belong to the Users.
Article 8 (Disclaimer and Limitation of Liability)
- The Operator makes no warranties regarding the accuracy, completeness, usefulness, timeliness, or other aspects of the content of the App. The App is provided "AS IS."
- The Operator shall not be liable for any of the following:
- Accuracy of data entered in the App
- Errors in travel distance, speed, etc. caused by GPS accuracy
- Accuracy of vehicle inspection certificate QR code scanning results
- Loss or corruption of data resulting from the use of the App
- Malfunction of the App caused by device failure, communication environment, OS updates, etc.
- Incompleteness of ride records when background location tracking is interrupted due to iOS restrictions
- Any accidents, injuries, death, property damage, or other damages that occur while using the App (including during ride recording)
- User driving decisions based on information displayed by the App (routes, speed, distance, etc.)
- The App is a supplementary tool for ride recording and vehicle management, and is not intended for navigation, driving assistance, or safety management. Do not use the information displayed by the App as a basis for driving decisions.
- The App assists in managing vehicle inspection expiration dates and maintenance schedules, and is not a substitute for legal notices or obligations. Users are responsible for fulfilling their legal obligations regarding vehicle inspections and maintenance.
- Except in cases of intentional misconduct or gross negligence by the Operator, the Operator shall not be liable for any damages incurred by Users arising from the use of the App.
Article 9 (Changes, Suspension, and Termination of the Service)
- The Operator may change, suspend, or terminate all or part of the Service without prior notice to Users in any of the following cases:
- When performing maintenance or updates to the App's systems
- When the provision of the Service becomes difficult due to force majeure such as earthquakes, lightning, fire, or power outages
- When the Operator determines that the provision of the Service is otherwise difficult
- The Operator shall not be liable for any damages incurred by Users due to any changes, suspension, or termination of the Service.
- In the event of termination of the Service, the Operator shall endeavor to notify Users in advance to the extent possible.
Article 10 (Data Handling)
- Data entered in the App is, in principle, stored only on the User's device.
- Users are responsible for storing and managing their data. If data is lost due to uninstallation of the App, device initialization, etc., the Operator shall not be obligated to recover such data.
- For details on data handling, please refer to the separately established Privacy Policy.
Article 11 (Apple Standard Terms)
- The App is distributed through the App Store of Apple Inc. In addition to these Terms, the "Licensed Application End User License Agreement" (hereinafter referred to as "Apple Standard EULA") established by Apple Inc. applies to the use of the App.
- In the event of any conflict between these Terms and the Apple Standard EULA, the more restrictive terms shall prevail.
- Apple Inc. shall not be obligated to provide any support or maintenance for the App.
Article 12 (Exclusion of Antisocial Forces)
- Users represent and warrant that they are not, now or in the future, members of organized crime groups, organized crime group members, quasi-members of organized crime groups, organized crime group-related companies, corporate extortionists, social movement racketeers, political activity racketeers, special intelligence violence groups, or any other similar parties (hereinafter referred to as "Antisocial Forces").
- If the Operator determines that a User is an Antisocial Force, the Operator may suspend the User's use of the Service without prior notice.
Article 13 (Prohibition of Assignment of Rights and Obligations)
Users may not assign, transfer, or pledge all or any part of their rights or obligations under these Terms to any third party without the prior written consent of the Operator.
Article 14 (Changes to the Terms of Service)
- The Operator may change these Terms in any of the following cases:
- When the changes to these Terms are in the general interest of Users
- When the changes to these Terms are not contrary to the purpose of these Terms and are reasonable in light of the necessity of the changes, the appropriateness of the content after the changes, and other circumstances pertaining to the changes
- When changing these Terms, the Operator shall notify Users of the effective date of the changes and the content of the revised Terms through the App or other appropriate means by the effective date.
- The revised Terms of Service shall take effect from the effective date set forth in the preceding paragraph.
- If Users use the App after the effective date, they shall be deemed to have agreed to the revised Terms of Service.
Article 15 (Severability)
If any provision or part thereof of these Terms is determined to be invalid or unenforceable under applicable laws, the remaining part of such provision and the other provisions of these Terms shall continue in full force and effect.
Article 16 (Governing Law and Jurisdiction)
- These Terms shall be governed by and construed in accordance with the laws of Japan.
- In the event of any dispute between a User and the Operator regarding these Terms or the Service, the Tokyo District Court shall be the exclusive court of first instance.
